Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of brother's daughter scheduled on 29th April, 2012.
Since papers were submitted by office to us, considering the urgency of the matter, we had asked the learned APP to ascertain the genuineness of the matter and it was also directed to list the matter for hearing in the second session.
Learned APP, under the instructions of Vallabh Vidyanagar Police Station, submitted that the ground mentioned in the application is genuine.
From jail remarks, we find that whenever the applicant-convict was released on temporary bail or on furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant shall be enlarged on temporary bail for a period of one week from the date of his actual release on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that applicant shall surrender to the jail authority on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
Learned APP is directed to intimate this order to the jail authority.
