1.Rule. Mr.N.D. Gohil, learned A.P.P., waives service of notice of rule on behalf of the respondent. Having regard to the facts of the case, the application is heard today.
2Convict-petitioner, PUNAM @ SHOBHA OMPRAKASH, who is undergoing sentence in the Central Prison, Vadodara, has filed this application to release her on regular bail. Learned APP, Mr. Gohil, has produced jail remarks sheet of the petitioner, which indicates that she had already remained in custody for 8 years and 11 months.
3.The parties do not press for reasoned order and, therefore, we are not assigning reason for releasing the petitioner on regular bail.
4.In view of peculiar facts and circumstances of the case, we are inclined to release the petitioner on regular bail. The petitioner, PUNAM @ SHOBHA OMPRAKASH, is ordered to be released on bail on the following conditions:
(i)She deposits Rs.10,000/- in the City Sessions Court, at Ahmedabad.
(ii)She furnishes two solvent sureties in the sum of Rs.10,000/- each.
(iii)She executes a personal bond that, while she is on bail, she will stay at House No.513, Janatanagar, Chandkheda, District Gandhinagar, and she will not leave the jurisdiction of Ahmedabad District and Gandhinagar District.
(iv)She shall mark her presence at Adalaj Police Station, on every Monday any time between 10.00 a.m. and 2.00 p.m.;
5.If breach of any of the above conditions is committed, the Police Officer of Adalaj Police Station shall be at liberty to apply for cancellation of bail of the petitioner.Bail bond to be furnished before the City Sessions Court, Ahmedabad.
6.Rule is made absolute to the extent indicated hereinabove only.
7.Office is directed to send copy of this order to
(i)Superintendent of Central Prison, Vadodara;
(ii)Police Officer incharge of Adalaj Police Station, for necessary action and compliance.
