JUDGMENT / ORDER

Heard learned advocates for the parties. The petitioner possesses qualification of Shastri awarded by Bruhad Gujarat Sanskrit Parishad. Under Government Resolution dated l9th October, l985, said qualification has been considered equivalent to a degree awarded by the recognized university.
Pursuant to the advertisement published by the Gujarat Public Service Commission in the year l993, the petitioner applied for the post of translator in the Legal Department. Requisite qualification for appointment to the post of translator in the legal department has been mentioned to be that of, inter alia, a degree in Arts, Science or Commerce or Law awarded by the recognized university. The petitioner's entry for the written examination has been cancelled by the Commission considering the petitioner ineligible for the post of translator. Feeling aggrieved, the petitioner has preferred this petition.
Learned advocate Mr.Majmudar has contended that the qualification of Shastri has been considered equivalent to that of a degree awarded by a recognized university and thus, the petitioner should be considered to be eligible for the post of translator. Claim of the petitioner has been contested by the Commission. The Commission has referred to the recruitment rules for the post of translator which are published on 22nd February, l984. Recruitment rules require that for appointment to the post of translator, candidate should possess degree of a recognized university in arts, commerce, science or law. Thus, the recruitment rules makes it clear that no other qualification except that mentioned hereinabove shall be considered as requisite qualification for such appointment. The petitioner admittedly does not possess any of the aforesaid qualification. Possession of equivalent qualification does not make the petitioner eligible for the appointment to the post of translator. In the circumstances, the petition is summarily rejected. Notice is discharged. There shall be no order as to costs.
