1.Applicant has filed this application under Section 5 of the Limitation Act, 1963, praying to condone delay of 16 days caused in filing abovenumbered First Appeal against judgment and decree dated August 27, 1998 passed by the learned Civil Judge (S.D.), Valsad, in Special Civil Suit No.216 of 1993. 2Heard the learned advocates for the parties.
3.As sufficienit cause is shown by the applicant for not filing appeal within the period of limitation, in my view, the delay caused in filing First Appeal deserves to be condoned.
4.The Civil Application is allowed. Delay is condoned. Rule is made absolute with no order as to costs.
