The present Civil Application has been filed by the Applicant for condonation of delay of 23 days in filing the First Appeal on the grounds stated in the Application inter alia that the Applicant was not informed by the Advocate of the Trial Court and thereafter he had to arrange for the resources and the money for filing the Appeal and therefore the time has been consumed.
Heard learned Advocate for the Applicant and learned AGP Mr. Devang Dave appearing for Respondent No.1.
In view of the reasons mentioned in the Application, sufficient cause is made out for condonation of delay. It is well accepted that the party need not be deprived of his right to approach the Court for redressal of his grievance for want of resources / money. Therefore, the sufficient cause is made out. The Hon'ble Apex Court in catena of judicial pronouncements has laid down the guidelines with regard to the approach in such matters of condonation of delay. Therefore, the present Civil Application deserves to be allowed and accordingly stands allowed. Delay is condoned. Rule is made absolute.
