1. The applicant has complained of non-compliance of the direction issued by Division Bench of this Court in Special Civil Application No.8612 of 2011 vide order dated 25.11.2011, whereby the respondent was required to dispose of the application of the applicant made under Section 28-A of the Land Acquisition Act within a period of three months from the date of certified copy of the order was produced.
2. Today, learned Assistant Government Pleader Ms. Thakkar has placed on record a copy of order dated 3.3.2012 passed by Deputy Collector, Land Acquisition Office at Godhra, whereby the application of the applicant has come to be decided.
3. Learned advocate for the applicant, however, stated before the Court that though the order is passed on 3.3.2012, whereunder decision is taken to give benefit of compensation as per the award passed by the Reference Court with other statutory benefits, actual payment has not been made till today.
4. Taking note of the fact that application was decided on 3.3.2012, we are of the opinion that present contempt proceedings are not required to be continued any further. However, since learned advocate for the applicant has drawn our attention to the effect that even after order dated 3.3.2012, no payment is made, we expect that the concerned authority shall take necessary steps to see that pursuant to the aforesaid order, payment in favour of the applicant-claimant is released at the earliest.
5. With the above observations, we close the contempt proceedings at this stage. Accordingly, the application is disposed of.
