(Per : MR.JUSTICE J.N.BHATT) Learned advocate Mr.Vibhuti Nanavati appearing for learned advocate Mr.P.V.Nanavati stated before us, at the very outset, that Mr.P.V.Nanavati, who is in charge of this matter, has, unfortunately, become victim of sickness this morning and, therefore, adjournment was requested. Mr.Mihir Thakore, learned counsel for the respondent-company submitted before us that the matter is old and big stake is involved as the petitioner Insurance Company has not paid the full amount, as claimed by the respondent Company. He further submitted that the matter is time and again notified before the learned Chief Justice and in absence of any interim order, he objected to the grant of adjournment. We, also, informed the learned advocate Mr.Vibhuti Nanavati that, in such cases, when Full Bench is constituted and objection for adjournment by the other side, adjournment is unusual and uncommon. However, in the larger interest of justice, reluctantly, we adjourn the matter with a specific observation that this matter will be conducted peremptorily on the next date. S.O. 10th August, 2001.
