The prayer in this petition under Article 226 of the Constitution of India is to direct the respondent Authority to give power connection to the present petitioner as prayed for and consider the petitioner's representation dated 4.5.1995.
On going through the representation dated 4.5.1995 reference has been made to application dated 20th May 1991. Both the aforesaid application and the representation relate to giving of electric connection as per the particulars set out in the representation/application in question.
When this matter was first placed on 25.10.1996 following order was passed :
"Mr.Parmar, learned Advocate for the petitioner makes a statement at the bar that representation dated 4.5.1995 is yet not considered. Such representation was given after the petitioner withdrew the earlier petition by making a statement to make such representation. Since the representation made as back as on 4.5.1995 is yet not considered, Notice returnable on 6.12.1996." After the aforesaid order was passed the matter was adjourned from 6.12.1996 to today.
No Affidavit in reply has been filed on behalf of the respondent Board. Under the circumstances the following directions are required to be issued :
The respondent Board is directed to consider the representation dated 4.5.1995 alongwith the petitioner's application dated 20.5.1991 in accordance with law and pass reasoned order within a period of six weeks from the date of receipt of writ of this direction.
In view of aforesaid direction Mr.Parmar, learned Advocate for the petitioner, under the instructions from his client, who is present in the Court, seeks to withdraw this petition. Permission granted. Disposed of accordingly. Notice discharged. No order as to costs.
Direct service permitted.
