Learned counsel for the respondent Ms. Kalpana Brahmbhatt has stated that the petitioner has already been taken back in service by order dated 22.7.96. It is rather amazing that despite this, this petition was filed in this court on 9.12.96 and an order issuing notice was obtained on 10.12.96. In any case it is clear that this Special Civil Application has become infructuous and Ms. Rupal Patel appearing for Mr.P.H.Pathak for the petitioner seeks to withdraw this Special Civil Application. The same is accordingly dismissed as withdrawn. Notice discharged. No order as to costs.
