(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1.0 We have heard Ms. Gargi Vyas learned counsel for M/s. Wadia Ghandy & Co. for the appellant and Mr. Pranav G. Desai learned counsel the Revenue.

2.0 Admit.

3.0 We formulate the following substantial question of law.

"Whether on the facts and in the circumstances of the case, the Appellate Tribunal was in right in law in determining the valuation of the property on mere assumption by averaging and without assigning any basis for the said valuation?"

4.0 Paper-book be ready within three months.
