JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Issue NOTICE, returnable on 3rd August 2012.
Since the petitioner has challenged the provisions contained in section 2(O) of the Secularization & Reconstruction of Financial Assets & Enforcement of Security Interest Act, 2002, let notice be also issued upon the learned Attorney General of India.
Let there be an ad-interim order in terms of paragraph 15 (c) of the petition for a period of three weeks from today, with liberty to apply for extension on the selfsame application after service upon the respondents.
The petitioner is directed to affirm an affidavit on or before 17th July 2012 that it is in possession of the property in question and further undertaking that it will not transfer, alienate or handover the property to any one else in any manner whatsoever.
Direct Service is permitted. Issue process today. The petitioner is also permitted to communicate this order to the respondents by any other means at its own expenses since the date of taking possession is fixed tomorrow.
