1. Learned counsel for the applicant submitted that the Reference Court in the impugned award having found that additional compensation should be granted at the rate of Rs.40.35 ps. per Sq. Mtr., in the operative portion ultimately awarded compensation at the rate of Rs.12.35 ps. per Sq. Mtr. This being an error, the applicant moved this Court by filing SCA No.15225 of 2011, which, however, was not entertained in view of the availability of the statutory appeal. Thereafter, the applicant preferred First Appeal. Thus, there is a delay on account of the applicant bonafidely pursuing the other remedy.
2. RULE returnable on 1st March 2012.
3. The respondent may notice that on the returnable date, we may even take up first appeal for hearing.
