JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI)
1. Learned Assistant Government Pleader Mr. Dave on the basis of the further instructions received by the respondents, stated that steps have already been undertaken to engage legal practioner to appear before the Bombay High Court and to seek permission for recovery of the dues of the workmen.
2. Learned counsel Ms. Rina Kamani submitted that dues of the workmen should take precedence over other dues and that, therefore, recovery, as directed by learned Single Judge of this Court, should not be effected.
3. When the respondents have taken steps in furtherance to the statement made before us previously, at this stage, we do not propose to take any further action in the present contempt petition. It is expected that the respondents shall pursue the proceedings before Bombay High Court without any waste of time on their part. Learned Assistant Government Pleader assures that proper proceedings shall be moved before the Court as expeditiously as possible.
4. Eventually, if for some reasons, permission for recovering the dues of the workmen is not granted, communication in this regard will be made to the applicant.
5. This contempt petition is disposed of at this stage with a liberty to apply again in case of difficulty. Rule is discharged.
