1. In response to the Rule issued, learned Additional Public Prosecutor Mr. Pandya appeared for the respondent-State and placed on record the jail record of the applicant.
2. The applicant seeks temporary bail on the ground that his son and daughter both are getting married on 24th and 25th April 2012.
3. We notice from the jail record of the applicant presented by learned APP, that in past, on 3 to 4 occasions, the convict was released temporarily and on all occasions, he had surrendered on time.
4. Additionally, counsel for the applicant pointed out that the applicant is convicted for the offence under Section 304 (Part-II) of the Indian Penal Code for 7 years, out of which, the applicant has already served out the sentence of 4 years and 7 months.
5. Considering the above aspects of the matter, the applicant-convict is ordered to be released on temporary bail for a period four weeks from the date of his release, on depositing a sum of Rs.5,000/- (Rupees Five Thousand only) before the jail authority. Upon completion of the period, he shall surrender to the jail authority.
6. The application is allowed. Rule is made absolute accordingly.
