(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant - convict has prayed that he be released on temporary bail to attend the marriage of his cousin sister schedule 26.04.2012.
Pursuant to the earlier order passed by this Court, learned APP Mr.Pandya, based on the reported of the Superintendent of Police, Amreli, has submitted that the ground mentioned in the application is genuine.
From the jail remarks, we find that earlier whenever the applicant-convict was released on temporary bail or on furlough, he has surrendered in time before the jail authority. The applicant - convict was already released on furlough in February 2012.
Considering the totality of the facts, the applicant - convict is ordered to be released on temporary bail for a period of three days i.e. from 25th April 2012 to 27th April 2012 on personal bond of Rs.5,000/- and one surety of like amount with the further direction that the applicant shall surrender on 28th April 2012 before the Jail Authority in time.
The application is allowed to the aforesaid extent. Rule is made absolute. Direct service is permitted, today.
