In this group of matters the applicant has prayed for review of the order passed by this court on 19.8.1996 by directing that the recovery may be effected from Shri Jawahar Vakharia of M/s. K.J. Vakharia & Co. now known as "Rajan Prints" and to direct that the same may not be recovered from the applicant. According to the applicant he was at one time a partner in the respondent No. 5, but the charge of respondent No. 5 is taken over by Shri Jawahar K. Vakharia from 27.10.1992. Under the order dated 19.8.1996 since the learned A.G.P. made a statement that the Collector will effect recovery pursuant to the certificates within six weeks from the date of the receipt of the order, a direction was given that the Collector may effect recovery on the basis of the recovery certificates which were issued in favour of the original petitioners. The said order does not fix any liability of anyone and if in the process of effecting recovery, any contentions are raised by the present present applicant they will be dealt with by the Collector in accordance with law. Needless to say, the Collector will effect recovery against such persons from whom the amount can be lawfully recovered. Earlier order made by this court is obviously without prejudice to the rights and contentions which may be lawfully raised by the parties including the present applicant. There is no ground made out in these applications for review of the earlier order. These applications are therefore rejected.
