The learned Additional Public Prosecutor waives service of Rule for the respondent-State.

In view of the fact that there are findings of facts arrived at by the learned Trial Judge and fact that the appellant himself was negligent in filing the appeal as he had come up before this Court after five years, we are not inclined to grant bail. The application is dismissed. Rule is discharged.
