JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL)
1. It appears that no process was issued in any of the matters to the respondents and the matter came to be dismissed for default on account of non-removal of office objections and in making the applications for restoration, there is delay of 66 days as well as 74 days in the respective applications.
2. Learned advocate for the applicants states that all office objections shall be removed, including payment of Court fee, within a period of four weeks, if the main first appeals are restored. He submitted that Court fee could not be paid on account of non-availability of the fund of compensation as the same could not be withdrawn from the Reference Court
3. Hence, all concerned main First Appeals are restored and the delay is also condoned, both on condition that the applicants remove all office objections within a period of four weeks from today and the same is verified by the office.
4. All Civil Applications as well as the concerned Misc. Civil Applications are disposed of accordingly.
5. Office shall verify as to whether Civil Application No.13428 of 2011 with MCA (Stamp) No.3340 of 2011 is for the same relief, like in Civil Application No.4383 of 2012 with MCA (Stamp) No.820 of 2012 or not and if yes, Civil Application No.4383 of 2012 in MCA (Stamp) No.820 of 2012 would not survive and they shall be only for restoration of First Appeal No.2396 of 2011.
