Learned Advocate Mr.M.R. Mengde states that petitioner No.1 has already expired and his heirs are not willing to proceed further with this Special Civil Application. He, therefore, requests that name of petitioner No.1 may be allowed to be deleted from the record of this Special Civil Application because, according to him, the Department is not finalising the pension case of the widow of the said petitioner on the ground that the petition is pending. The death certificate is annexed with the Civil Application. Though, of course, no affidavit is filed in the Civil Application, Mr.Mengde states that since she has already addressed a letter to the concerned Advocate, on the basis of the same, this Civil Application is filed. In view of the aforesaid facts, the name of original petitioner No.1, Ramanbhai Somabhai Patel, is allowed to be deleted from the record of the case. The petition will now proceed further as regards rest of the petitioners. This Civil Application is accordingly disposed of with the aforesaid direction.
