Learned Advocate Mr. Master for M/s. N.J. Mehta Associates for the petitioner states before the Court that by the letter dated 9-1-1986 the respondents have withdrawn the order of suspension of the petitioner as well as Departmental Inquiry instituted against him. By the said order, the petitioner was directed to report for duty immediately. The petitioner has in accordance with the said letter reported for duty and he is discharging his duty till date since then. Zerox copy of the said order be taken on record. The original of this order is shown to learned Advocate Mr. Patel who appears for Mr. Bhagat for respondents and correctness or otherwise of the said letter is not disputed at this stage.
In view of these state of affairs, learned Advocate for the petitioner seeks permission to withdraw this petition without prejudice to his right of consequential benefits which according to him are not given by the Department. Permission to withdraw the petition is granted. Petition stands disposed of as withdrawn. Rule is discharged. However, there shall be no no order as to costs.
