Rule. Service of rule waived by Mr. H.L. Jani, Ld. APP for the State.
2.Heard. The Ld. Advocate for the petitioners and Ld. APP for the State jointly submit that reasoned order may not be passed.
3.Having regard to the facts and circumstances of the case, following directions are issued :-
2,25,000/(Rupees two lacs twenty five thousand only) with solvent surety of Rs.1,50,000/- and cash security in the sum of Rs.75,000/- (Rupees seventy five thousand only) for petitioner no. 1 and bail in the sum of Rs.1,10,000/(Rupees one lac ten thousand only) with solvent surety of Rs.1,00,000/- (Rupees one lac only) and cash security in the sum of Rs.10,000/- (Rupees ten thousand only) for petitioner no. 2 (amount of cash security to be deposited in the trial Court) on following conditions :-
i. they shall not take undue advantage of their liberty or abuse their liberty, ii. they shall not act in a manner injurious to the interest of the prosecution, iii. they shall maintain law and order, iv. they shall mark their presence on every Saturday at D.C.B. Crime Branch, Vadodara between 9.00 a.m. to 2.00 p.m. v. they shall not leave the limits of State of Gujarat without prior permission of the trial Court, vi. they shall furnish their correct and complete address of their residence at the time of execution of bond to the trial Court and shall not change their address without prior permission of the said Court.
vii. they shall surrender their passports, if any, to the trial Court within one week.
4.If breach of any of the above conditions is committed, the Sessions Judge at Vadodara will be free to issue warrant or take appropriate action in the matter.
5.Bail to be furnished before the lower Court having jurisdiction to try the case. Rule is made absolute accordingly. DSP.
