The only grievance made in this petition under Article 226 of the Constitution is that the Development Commissioner did not grant interim stay during the pendency of the petitioner's appeal against the order of the District Development Officer, Junagadh removing the petitioner from the office of Sarpanch of Ranpar Gram Panchayat, Taluka Bhesan, Junagadh District. While issuing the notice on 16.8.2000 this court has granted interim relief against the operation, implementation and execution of the order dated 3.8.2000 passed by the District Development Officer. It was also clarified that the pendency of this petition grant of interim relief would not does not preclude the Development Commissioner from hearing and deciding the petitioner's appeal.
2.Having heard Mr.Jayant Patel for the petitioner and Mr.K.T.Dave, Ld.AGP for respondent No.1 this petition is disposed of with a direction that the interim relief granted earlier shall continue during pendency of appeal before the Development Commissioner, and also shall continue for 15 days from the date of communication of the order to the petitioner which may be passed in the appeal, and the appeal shall be disposed of as expeditiously as possible, and in any case, within two months from the date of receipt of writ of this court or certified copy of this order, whichever is earlier. The learned Counsel for the petitioner undertakes that the petitioner shall cooperate with the authorities for expeditious disposal of the appeal.
3.The petition is disposed of in terms of aforesaid directions. Notice is discharged. Copy of this order shall be given to Mr.K.T.Dave, Ld.AGP.
