Rule. Mr. D.N. Trivedi, learned counsel appears for the original claimants. Except the claimants, others being not the necessary parties, no process is required to be issued. The amount as directed by the Division Bench, by oversight has been deposited in the Trial Court. Mr. Nanavati, learned counsel has requested this court to direct the Tribunal to transmit the amount to this court so that the amount may be disbursed as per the orders passed by the Division Bench of this court. Instead of calling the amount here, ends of justice would be met with if the Trial Court is directed to disburse the amount as per the orders passed by the Division Bench of this Court in Civil Application No. 9283 of 1996 on 4.11.1996. A copy of this order be sent to the Tribunal for compliance. In the order portion, it is observed that the security was to be given to the satisfaction of the Registrar. In view of the order which we have passed, it goes without saying that the security shall be given to the satisfaction of the Registrar, City Civil Court, Ahmedabad. Rule is made absolute accordingly with no order as to costs.
