In this petition, the petitioner has inter alia contended that there is total inaction and failure to perform duties imposed under law on the part of the Government officers with regard to directing respondent No.2 company to implement the terms of award passed by the Labour court, Ahmedabad whereby the petitioner came to be reinstated with full back wages and also continuity of service.
The petitioner union on several occasions addressed various representations to the respondents but they have not been attended to and no action is taken despite expiry of period of more than one year. Prosecution against respodents Nos. 2 to 6 is also not initiated by respondent No.1.
Having regard to the facts and circumstances, respondent No.1 is directed to decide the application dated 2.5.1996 and subsequent remindr dated 24.6.1996 as expeditiously as possible but not later than four weeks from the date of receipt of writ of this court,failing which a serious view will be taken and it would be open to the petitioner to move this court for further appropriate order. In view of the aforesaid direction, the learned advocate for the petitioner seeks permission to withdraw this petition at this stage. Permitted to withdraw. Notice discharged. No order as to costs.
