JUDGMENT / ORDER

The petitioner has been selected for the post of Police Constable and he has been issued appointment order on 4th September 1996. However, on account of his involvement in a criminal offence he has not been permitted to resume the duties pursuant to the aforesaid appointment order. The petitioner is one of the accused in the offence registered at Crime Register No.182/96 at Police Station, Mehsana. The offences alleged to have been committed by the accused are under sections 147, 148, 149, 307, 323, 324 and 326 of the Indian Penal Code and section 145 of the Bombay Police Act. The offences alleged to have been committed by the petitioner and the other accused are of grave nature. The offences alleged to have been committed by the petitioner and the other accused do amount to anti social activities and if proved would necessarily entail a sentence of imprisonment.
In the circumstances, respondents cannot be compelled to allow the petitioner to resume duty. Petition is, therefore, summarily rejected.
