The present Civil Application has been filed under Section 5 of the Limitation Act for condonation of delay by the Applicant - Employees State Insurance Corporation on the grounds stated in the Application. It is stated that the papers were considered for approval by the competent authority and after completing the procedure, legal opinion from the legal department was required, which consumed time. It is also stated that when the papers were handed over to the Advocate in the High Court, there was a vacation.
Heard learned Advocate Mr. Sachin D. Vasavada for the Applicant. Though served no one has appeared.
Therefore, considering the grounds mentioned in the Application, sufficient cause is made out. The Hon'ble Apex Court in catena of judicial pronouncements has laid down the guidelines with regard to the approach in such matters of condonation of delay. The present Civil Application therefore deserves to be allowed and accordingly stands allowed. Delay is condoned. Rule is made absolute.
