#. On perusal of the papers, previous orders passed by this court and the averments made in statutory notice served, I am satisfied that this petition requires admission. It is pertinent to note that Mr.Bharat Patel who is one of the Directors in the respondent company was the Director in various companies including Hynoup Food & Oil Industries Limited which are put under caution advise No.353 dated 19.7.1999 (which is produced in Company Petitions Nos.206 and 207 of 1999) by the Reserve Bank of India. Mr.Bharat Patel who is holding the office of Director in Hynoup Food & Oil Industries Limited and other associates mentioned in the caution advise has executed the pro note as guarantor of the respondent company for the transaction entered by the respondent company with the petitioner bank. So, submission of Mr.Desai, learned counsel appearing for the petitioner bank has some strength that the respondent company is the group company of Hynoup Food & Oil Industries Limited. The registered office of the respondent company is in the same building/premises where the registered office of Hynoup Food & Oil Industries Limited is situated, that is, at Maruti House, Opp: Air India Building, Ashram Road, Ahmedabad-380 009. As Mr.A.L.Shah, learned counsel appearing for the respondent company is not present, I defer my order as to the publication of the advertisement of admission of this matter etc. till the adjourned date.
