JUDGMENT / ORDER

Considering the reasoning given by the Tribunal to the effect that the applicant was permitted to join Ankur School only by way of an interim order of the Tribunal, and, ultimately, now the Department has absorbed the petitioner in Jyoti Vidyalaya, Sola Road, Ahmedabad, it cannot be said that the petitioner has a vested right to remain only in Ankur School, especially when that School had accepted the petitioner's services only for a limited period by way of interim order of the Tribunal. Now, it is not in dispute that the petitioner is already absorbed in Jyoti Vidyalaya, Sola Road, Ahmedabad. In fact, the D.E.O. has also recommended the case of the petitioner for that school and the school was threatened that in case they do not absorb the petitioner, grant will be withdrawn. Under the circumstances, the services of the petitioner was transferred to Jyoti Vidyalaya. The Tribunal has considered the aforesaid fact in detail and I do not find any infirmity in the order of the Tribunal. The fact remains that the services of the petitioner are protected and the only thing is that he will have to resume duty at Jyoti Vidyalaya, Sola Road, Ahmedabad. Since the Tribunal has not committed any error of law or of jurisdiction, I do not find any substance in this petition, which is substantially under Article 227 of the Constitution of India. The petition is accordingly dismissed.
