MR ANSHIN H DESAI for Respondent(s) : 3, MR ABDUL K SHAIKH for Respondent(s) : 3, ====================================== CORAM : HONOURABLE MR.JUSTICE MD SHAH Date : 15/09/2012 ORAL ORDER By way of this Appeal From Order, the appellant challenges the order dated 20.6.2012 passed below Exhibit 5 in Special Civil Suit No.131 of 2011 by the learned Fourth Additional Senior Civil Judge, Nadiad.
During the course of arguments, learned advocate Mr. Bharda for the appellant and learned advocate Mr. Desai for the respondent No.3 state that no reasoned order is required to be passed, if learned trial Court is directed to finally decide and dispose of the Special Civil Suit No.131 of 2011 expeditiously.
Considering the peculiar facts and circumstances, learned Fourth Additional Senior Civil Judge, Nadiad, is directed to dispose of Special Civil Suit No.131 of 2011 on its own merits and in accordance with law, within one year from this order, without being influenced by this order.
It is needless to state here that any transaction that takes place AO/286/2012 2/2 ORDER during the pendency of the suit, will be subject to the final outcome of the suit.
In view of above, the Appeal From Order is disposed of accordingly, without expressing any opinion on merits. Notice is discharged.
In view of the order passed in Appeal From Order, no order in Civil Application No. 8647 of 2012 and is accordingly, disposed of. Notice is discharged.
