JUDGMENT / ORDER

The wife has filed O.A. No. 412/2013 on the file of the Family Court, Kozhikode seeking divorce. The husband has filed O.P. No. 712/2013 on the file of the Family Court, Ernakulam seeking restitution of conjugal rights. The wife is pursuing her studies at Kozhikode while the husband is employed in a travel agency at Ernakulam.
2. It is a virtual impossibility for the wife to travel all the way from Kozhikode to Ernakulam for the conduct of the case. This is especially so since she has to depend on her aged and ailing parents. It may only be a slight inconvenience for the husband to travel from Ernakulam to Kozhikode for the purpose of the case. A joint trial of both the proceedings is imminent since the issues are intertwined.
3. I therefore order transfer of O.P. No. 712/2013 from the Family Court, Ernakulam to the Family Court, Kozhikode.
2 Tr.P(C) No. 235/2013 The transferee court shall issue notice to the parties and take the proceedings to a logical end.
The Transfer Petition is allowed.
