When the matter is called, it is represented by the learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the orders of this Court in W.A.Nos.499, 694 and 695 of 2004 dated 19.06.2014 and a copy of the said order is placed on record by the learned counsel for the petitioner. In the present writ petition, respondent No.2 died pending the writ petition and his legal representatives have been brought on record as respondents 3 to 7 vide WPMP.NO.33548 of 2012.
Following the above referred Judgment in W.A.Nos.499, 694 and 695 of 2004 dated 19.06.2014 and for the reasons recorded therein, writ petition is disposed of setting aside the G.O.Ms.No.57 Education (C.E.- II) dated 27.01.2000. It is further directed that the respondents/legal representatives shall be entitled to be paid back-wages from the date of dismissal, till the date on which the deceased employee attained the age of superannuation, to the extent of 50% and death-cum-retirement benefits in accordance with the relevant rules of the Government. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
