This criminal appeal has been filed under Section 378 (4) Cr.P.C. by the appellant against the acquittal of respondent Alok Kumar passed by IIIrd Additional Munsif Magistrate, Meerut vide order dated 27.5.1988 in Case No. 26/1988.
The Court has been informed both the appellant and the respondent have died and nobody is pursuing this appeal at present.
This appeal is pending since 1988.
Considering the provision of Section 256 Cr.P.C. and considering that this appeal is pending since 1988, no fruitful purpose will be achieved in the pendency of this appeal.
Considering the provision of Section 256 Cr.P.C., the appeal is dismissed as infructuous.
Office is directed to send back the lower court record to the concerned trial court.
