Heard learned counsel for the petitioner, Sri Anadi Krishna Narayana, learned counsel for respondent no.3, Sri Gyan Prakash Shrivastava, learned counsel for respondent no.4 and perused the record.
The petitioner has preferred the present petition under Article 227 of the Constitution of India inter-alia with the prayer to direct the respondent no.1 i.e. Civil Judge (Senior Devision), Kanpur Nagar/ Small Causes Court, Kanpur Nagar to decide the Original Suit No.1630 of 2005 (Smt. Anvari Begum Vs. State Bank of Indore and Others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no.1 i.e. Civil Judge (Senior Devision), Kanpur Nagar/ Small Causes Court, Kanpur Nagar to consider and decide the aforesaid suit in accordance with law most expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
