This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair and proper investigation in respect of FIR dated 17.06.2019, registered as Case Crime No. 70 of 2019, under Sections 363, 366 of I.P.C. and Section 8 of POCSO Act, P.S. Khanna, District Mahoba.
According to the petitioner, on 17.06.2019 she lodged a report against two accused persons, under sections 363,366 of I.P.C, read with section 8 of POCSO Act, but till date nothing has been done by the police. Learned counsel for the petitioner submits that direction may be issued to the police authority to conclude the fair and impartial investigation in the matter.
State counsel submits that a suitable direction may be issued to the police authorities for concluding the investigation in accordance with law.
The present petition is disposed of directing the police authorities to conclude the investigation of the said case in fair and impartial manner in accordance with law as expeditiously as possible.
Petitioner is at liberty to file a fresh representation before the S.P, Mahoba and in the eventuality of doing so, the S.P. concerned shall look into the matter personally.
It is made clear that this Court has not expressed any opinion on merit of the case and the police authorities to act in accordance with law.
If the police fails to conclude the investigation, the petitioner would be at liberty to approach the higher police authorities.
