Heard learned counsel for the parties.
It is informed by counsel for the appellants that Chhedi Prasad, respondent no. 2/1 had died and he seeks time to move substitution application. In this appeal, respondent no 1 is Tapesar Prasad who was also respondent no. 1 in first appeal. In first appeal, respondent no. 2 was Sant Ram who has been impleaded as respondent no. 2/2 in this second appeal but respondent no. 2/1 of this appeal, namely, Chhedi Prasad was not party in first appeal or in original suit. Apparently, it appears that he has unnecessarily been impleaded as party in this appeal. Learned counsel for the appellants requests for time to clarify this position, which is granted.
