The petitioner herein is the sole accused in C.C.No. 92/2014 of the Judicial First Class Magistrate Court, Kolenchery. The offences involved are under Sections 341, 323, 324 and 294(b) IPC. Crime in the said case was registered on the complaint of one Prince Thomas. Petitioner now seeks orders quashing the prosecution, on the ground that he and Prince Thomas have come to terms amicably out of court. The defacto complainant, Prince Thomas, is the 1st respondent in this proceeding. He has filed affidavit to the effect that he has settled the dispute with the accused, and he has no grievance or complaint now. I am well satisfied that the whole dispute stands really settled, and that continuance of prosecution in such a situation will not serve any purpose, other than wasting the precious time of the court, because nobody will support the prosecution, if the case goes to trial. In the result, this Crl.M.C. is allowed. The prosecution as Crl.M.C. No. 7012/14 2 against the petitioner herein in C.C.No.92/2014 of the Judicial First Class Magistrate Court, Kolenchery, will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioner will stand released from prosecution. The bail bond, if any, executed by the petitioner will stand discharged.
