This application u/s 482 Cr.P.C. has been preferred on behalf of applicant seeking the quashing of entire proceeding in Session Trial No.172 of 2002, u/s 323, 342, 506 I.P.C. and Section 3(1) (X) of SC/ST Act, arising out of Case Crime No.111 of 2002, P.S.-Billhaur, District-Kanpur Nagar, pending in the court of Special Judge, SC/ST Act, Kanpur Dehat.
Heard learned counsel for the applicant and learned A.G.A. for the State and also perused the record.
This is State case where the proceedings before the Special Judge, SC/ST Act, Kanpur Dehat is pending since 2002. Since the year 2014 the applicant has absented himself and the warrants were issued against him way back on 20.9.2014, even then he is not appearing in the Court.
Now the applicant has come up before this Court by filing this application u/s 482 Cr.P.c. seeking the direction that he may be permitted to surrender before the court concerned as he is ready to co-operate in the early conclusion of trial. On this solemn undertaking given by learned counsel for the applicant on behalf of applicant, it is directed that all the coercive measures issued against the applicant shall not be executed provided the applicant shall appear before the court concerned on or before 2nd January, 2020. If the applicant appears and files his bail application, the same shall be considered and decided by the concerned court taking into account the facts and circumstances of the case. If the court concerned deems it appropriate to release the applicant on bail, the heavy surety shall be fastened upon him with the undertaking that he would not seek any adjournment in the matter. The Court concerned would make all necessary endeavours to conclude the trial latest by 30th June, 2020.
With the aforesaid observations, this application stands disposed of.
