Heard learned counsel for the petitioner and perused the record.
The present petition has been filed for direction upon the court concerned to decide Original Suit No.1815 of 2014 (Km. Riddhi Tripathi Vs. Sushil Kumar Tripathi) within stipulated period.
From the order-sheet of the case it appears that on 25th January, 2018, the plaintiff was required to file application seeking condonation of delay in moving substitution application.
According to learned counsel for the petitioner, the substitution application was later allowed and the interim order is being extended from one date to the other but the suit is not proceeding.
From the order sheet of the case it appears that on the last date, the interim order was extended and 10th May, 2018 is the next date fixed. However, it is not clear whether till date evidence has been recorded or not.
Under the circumstances, this Court does not consider it appropriate to issue any specific direction to decide the suit, at this stage. However, it is left open for the petitioner to move an application for expediting the proceeding, if so advised.
With the aforesaid liberty/observation, the petition is
disposed off.
