Heard learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
This petition has been preferred for the respondents being commanded to declare the petitioner as successful in the Preliminary Examination conducted by the Commission for the post of Review/Assistant Review Officers. The contention raised was that although the petitioner has obtained more than the cut off prescribed, he has been declared unsuccessful.
Sri M.N. Singh, the learned counsel appearing for the Commission has on instructions apprised the Court that by an order dated 12 December 2018 the petitioner has been debarred by the Commission from participating in any examinations conducted by it. It is in this backdrop that the Commission has refused to consider the candidature of the petitioner. Although, Sri Singh states that this order was duly communicated to the petitioner, learned counsel for the petitioner disputes this fact. Sri Singh has before this Court handed over a copy of the order dated 12 December 2018 to the learned counsel for the petitioner. Since the order of debarment has not been assailed the relief as claimed cannot be granted.
Accordingly while this petition is dismissed, it is provided that this order shall not preclude the petitioner, if so chosen and advised to challenge the order dated 12 December 2018.
