Heard learned counsel for the petitioner and perused the record.
The present petition has been filed for direction upon the court of Principal Judge, Family Court, Agra to decide Divorce Suit No.44 of 2009 (New No.207 of 2015) (Anurag Vs. Smt. Tanu), under Section 13 of Hindu Marriage Act within stipulated period.
From the order-sheet of the case it appears that on 12th September, 2017 date 18th October, 2017 was fixed for leading ex-parte evidence. Thereafter, an application was moved for recall of the said order and thereafter dates are being fixed. It also appears that on one date i.e. 8th February, 2018, matter was adjourned by imposing costs on the party concerned.
Considering that the matter relates to matrimonial dispute, this Court considers it appropriate to dispose of this petition by observing that the court concerned shall ensure that the proceedings are brought to its logical conclusion expeditiously, in accordance with law, keeping in mind the provisions of 21-B of Hindu Marriage Act, in absence of any legal impediment.
With the aforesaid observation, the petition is disposed off.
