JUDGMENT / ORDER

Heard learned counsel for the applicant and the learned A.G.A.
It is contended by the learned counsel for the applicant that the applicant was not named in the FIR and the similarly placed co-accused Praveen Kumar @ Babu Upadhyaya, Raj Kumar Singh and Prahlad Singh have been granted bail by different orders of this Court on the ground that their names were disclosed by the sister of the deceased after five days and that the delayed disclosure was an after thought. Learned AGA could not dispute this position.
Having considered the submissions of the parties and without expressing any opinion on the merits of the case, let the applicant Anurag Salooja alias Prince involved in case crime No. 553 of 2009, under Sections 364, 368, 302, 201, 392/34 IPC, P.S Kotwali, district Basti be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned and further with the following conditions:
1. The applicant shall not tamper with the evidence.
2. The applicant shall report to the police station concernedin the first week of each month to show his good conduct and behaviour.
In default, the bail granted to the applicant shall be deemed cancelled and he shall be taken into custody forthwith.
