Following orders were passed in the matter on 29.5.2019:-
"Petitioner came to be employed as Rojgar Sewak in 2008. It appears from the record that petitioner is not receiving salary/honorarium from January 2010.
Learned Standing Counsel to seek instruction/file objection. Put up on 26 August 2019, as fresh."
Learned Standing Counsel has obtained instructions, copy of which has been furnished to the counsel for the petitioner today in Court. According to the instructions, petitioner has suppressed material facts inasmuch as his engagement as Rojgar Sewak was for a period of one year which was extended till the year 2010. It i stated that since the year 2012 petitioner has been engaged as Mate and is getting salary also. It is submitted that all such facts of engagement of petitioner as Mate and of getting salary have been suppressed by the petitioner.
It is submitted by the learned counsel for the petitioner that the petitioner is working as Rojgar Sewek.
In view of the specific stand taken by the respondents, this Court finds no justification to interfere in the matter in case petitioner is working as Mate and is also getting salary. Question of payment of honorarium as Rojgar Sewak during the same period would not arise.
Writ Petition fails and is accordingly dismissed.
