Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the applicant's protest petition dated 17.10.2016 against the final report submitted in Case No. 370 of 2016 (Anuradha Singhal Vs. Pragya Singhal), arising out of Case Crime No. 477 of 2015, under Sections- 452, 323, 504, 506, 427 I.P.C., Police Station- Sector-24 Noida, District- Gautam Budh Nagar, pending before the A.C.J.M., Court No. 1, Gautam Budh Nagar.
Learned counsel for the applicant submits that against the final report submitted in the FIR lodged by the applicant, he claims to have filed protest application on 17.10.2016 which has remained pending for more than one year.
Considering the fact that the applicant's protest application has remained pending for more than one year and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid application in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
