Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 29.09.2017 as well as the entire proceedings arising out of Case Crime No. 484 of 2017, under Sections- 323, 504, 506 I.P.C., Police Station- Achhnera, District- Agra as well as to direct the opposite party no. 2 to make further investigation in accordance with allegation made in FIR dated 28.08.2017.
Learned counsel for the applicant submits that thought a charge sheet has been submitted by the police however, that is based on incomplete/improper investigation. In this regard, the applicant claims to have filed an application before the learned Magistrate on 23.03.2018 seeking further investigation. The said application is stated to be still pending.
Without going into the merits of the case, the present application is disposed of with a direction to the learned Magistrate to decide the aforesaid application in accordance with law, as expeditiously as possible, preferably within a period of two months from the date of production of a certified copy of this order.
