The Court has perused the report of the Additional Civil Judge (Senior Division), Court No. 13, Allahabad dated 22.09.2021. The report makes a dismal reading. The report does not indicate what is the stage of hearing and which of the parties are appearing and if the case has proceeded to hearing what evidence has been led by parties. The next date fixed is reported to be 07.10.2021.
Heard Mr. Akshay Pratap holding brief of Mr. Chandan Sharma, learned counsel for the petitioner.
Since this Court does not propose to pass any order affecting the rights of parties, notice to the sole defendant-respondent is dispensed with. However, in case he feels aggrieved by this order, it shall be open to him to make an application in this decided matter.
The Prescribed Authority/Additional Civil Judge (Senior Division), Court No. 13, Allahabad before whom P.A. Case No. 12 of 2017 is pending shall now proceed to hearing and decide the said case fixing one date every week and shall not adjourn the case in any event. In the event there is any resolution by Members of the Bar to abstain from judicial work, the leaned counsel appearing in this case will assist the Court irrespective of the resolution of the Bar.
The District Judge shall take appropriate steps in the matter to ensure that there is no obstruction to the effective hearing on every date fixed.
This petition is disposed of in terms of the aforesaid order.
Let this order be communicated to the Additional Civil Judge (Senior Division), Court No. 13, Allahabad through the learned District Judge, Allahabad and the learned District Judge, Allahabad himself by the Registrar (Compliance) within 24 hours.
