1. Leave to amend the details and calculations.
2. By way of this petition, the petitioner has prayed for the following reliefs:-
"[a] to allow this petition and issue a writ of mandamus or any other writ, direction or order in the nature of writ, as may be deemed to be appropriate, quashing and setting aside the impugned public notice [copy at Annexure 'A'] i.e. the advertisement, published in the daily 'Damanganga Times' on 30-01-2012, issued by the respondent no.2, as also all subsequent proceedings, action, etc., contemplated or initiated by the respondents;
[b] to stay further proceedings in terms of the impugned public notice [copy at Annexure 'A'] i.e. the advertisement, published in the daily 'Damanganga Times' on 30-01-2012, issued by the respondent no.2, as also all subsequent proceedings, action, etc., contemplated or initiated by the respondents, pending admission, hearing and final disposal of the present petition;
and [c] to grant such further and other reliefs, as may be deemed to be just and proper."
3. Mr.
J.T. Trivedi, learned advocate with Mr. B.J. Trivedi for the petitioner submits that a statutory appeal challenging the award passed by the Board of Nominees in Summary Lavad Suit No.323 of 2004 is already filed before the Gujarat State Cooperative Tribunal and only because the Tribunal is yet to adjudicate upon the appeal, the present petition is filed. It would be open for the petitioner to file appropriate application for expediting the hearing of the appeal.
4. With these observations, the petition stands disposed of as withdrawn with no order as to costs. Direct service is permitted today.
