JUDGMENT / ORDER

Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents.
The petitioner's father was a follower in the Police Department which is said to be a permanent post. Unfortunately he died on 8th March, 2007 leaving behind his widow and two minor son, namely, Manup Kumar and the petitioner and minor daughter Sadhana. The petitioner, who is the eldest son of the deceased employee upon attaining the majority filed an application for compassionate appointment on Class IV post on 4.10.2011, i.e., within 5 years of limitation prescribed under the Dying-in-Harness Provisions. Thereafter, it appears that the petitioner also passed Intermediate Examination and he again made an application on 17.8.2012 for being appointed on the post of Constable.
It is submitted that both these applications are pending. So far as the first application of the petitioner for being granted appointment on compassionate ground on Class-IV post is concerned as he had only qualification of High School, the same has not been considered till date. So far as the other application for appointment as Constable is concerned, it filed beyond the limitation.
The writ petition is disposed of with the direction to the concerned authority to take appropriate decision on the application of the petitioner in accordance with law within a period of four months from the date a certified copy of this order is presented before it.
