Heard learned counsel for the petitioners; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 25.03.2021 registered as Case Crime No.221 of 2021, under Section 3/7 of Essential Commodities Act, P.S. Colonelganj, District Prayagraj.
The allegation in the impugned first information report is with regard to unauthorised re-filling of LPG cylinders and its sale. A complaint was made against the gas agency and FIR has been lodged by Supply Inspector after making an inquiry and on the basis of complaint which have support from a video clip that went viral.
Keeping in mind the nature of the allegations, the prayer of the petitioners 1 and 2, who are manager and driver respectively of the gas agency concerned, to quash the first information report cannot be accepted as a prima facie case of violation of Control Order is disclosed by the allegations made in the impugned first information report.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail.
