JUDGMENT / ORDER

Anumolu Prabhakara Rao, S/o. Nagabhushanam, Aged about 55 years, Occ: Agriculture, R/o.D.No. 7-47, Thulasamma Colony, Near Anjaneya Swamy Temple, Bandar Road, Poranki Village, Vijayawada – Rural, Krishna District. AND The Regional Passport Office, Rep. by its Regional Passport Officer, Secunderabad, Andhra Pradesh & another .. Petitioner .. Respondents The Court made the following:
HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12899 of 2014 ORDER:
The petitioner avers that he has applied for passport on 19.10.2012 bearing File No.HY6061617997112. The said application is not processed and no orders are communicated showing the reasons for not granting passport as requested by the petitioner.
2. Learned counsel for the petitioner avers that as per the information posted on the website of the respondent, the status shown is that police verification report is not clear and application is under review. Learned counsel for the petitioner submits that it is illegal on the part of the respondent to keep the application pending for so long without communicating the reasons. Learned counsel for the petitioner further submits that the petitioner was implicated in five criminal cases which are pending before the competent Court and they are at various stages. If only the respondent intimate the petitioner the reason for keeping the passport application pending, the petitioner would have taken appropriate steps. There is urgency in securing the passport since his children live abroad and it is necessary for him to visit his children.
3. Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the Regional Passport Officer, Secunderabad (1st respondent) to pass appropriate orders as warranted by law on the passport application submitted by the petitioner on 19.10.2012 and communicate the decision to the petitioner, if his request for grant of passport cannot be acceded to, within a period of three (3) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
