This Writ Petition is filed for a Mandamus to set aside order in proceedings, vide Rc.No.2757/2014/G, dated 19.07.2014, of respondent No.2, whereby he has suspended the petitioner's fair price shop authorization in respect of Fair Price Shop No.77 of Guntur City.
I have heard Sri K.Joseph, learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh).
A perusal of the record shows that the impugned order was passed by respondent No.2 as far back as 19.07.2014 and that, on the same day, a show cause notice was issued to the petitioner, in response to which, she is stated to have submitted her explanation on 28.07.2014.
In the above set of facts and circumstances, I am not inclined to interfere with the impugned order at this stage. Instead, respondent No.2 is directed to complete the enquiry, after considering the explanation of the petitioner objectively and giving her an opportunity of personal hearing during the enquiry, and pass a final order within a period of one month from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of.
As a sequel, WPMP.No.41322 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
